Australia’s biggest health insurer, Medibank Private Ltd, had announced that it is facing a second class action lawsuit regarding disclosing information about its cyber security systems before a data breach occurred last year.
In October of last year, Medibank announced that a hacker had accessed information belonging to 9.7 million current or former customers. The stolen data was later published on the dark web.
Quinn Emanuel Urquhart & Sullivan, a US-based law firm, claimed that the company failed to disclose information about the alleged issues with its cyber security systems, which violates its disclosure obligations. This claim was made in their class action lawsuit.
While Medibank stated its intention to defend itself, there has been no immediate comment from Quinn Emmanuel.
In early February, law firm Baker & McKenzie filed a lawsuit claiming a violation of the contract and Australian consumer law. Another case with similar claims has been filed recently.
“It is important that the rights of those affected by this data breach are upheld and that compensation claims can be made,” said a lawyer at Baker & McKenzie.
This situation should prompt Medibank to make sure it has proper cyber security measures in place and to ensure compliance with disclosure regulations. It is also an important reminder for businesses to take any and all measures to protect customer data from cyber attacks.
Since September of last year, several incidents of hackers have targeted Australian companies. Recently, Rio Tinto and Latitude Group were added to the list of companies that have been targeted.
